Driven by the will to durably structure long-term investments essential for infrastructure and public interest projects, this reform redefines the intervention scope of the institution by granting it unprecedented prerogatives. Henceforth, the structure will no longer rely solely on the goodwill of obligated actors, but will possess financial and administrative coercion mechanisms to combat circumvention and compel recalcitrant organizations to fulfill their transfer obligations.
Concretely, this coercive arsenal aims to neutralize evasion behaviors that deprive the institution of the capital necessary for its missions. When entities subject to legal provisions refuse or delay the transmission of required funds, the Fund may activate strict administrative and financial levers. Although the precise details of sanctions and application thresholds remain to be formalized by regulatory means, this paradigm shift reflects a manifest will of the State to more effectively centralize institutional savings. The stakes are high, as rigorous and unimpeded collection constitutes the indispensable foundation for financing national development lines.
At the heart of this bilateral strengthening dynamic, the text also extends the perimeter of mobilizable resources by granting the CDC-CI definitive ownership of sums deposited in its books and subject to prescription. In other words, capitals that remain unclaimed by their beneficiaries at the end of legal deadlines will no longer sleep indefinitely in accounts awaiting hypothetical restitution. They will irreversibly shift into the patrimonial sphere of the institution, thereby consolidating its financial base and broadening its investment portfolio.
This innovative provision, however, calls for absolute rigor in flux traceability. The success of this institutional transformation will depend on striking the right balance between the regulatory authority conferred upon the organization and the preservation of legal security. It will fall to authorities to ensure that the identification of prescribed sums is impeccable, guaranteeing that the rediscovered financial striking power of the CDC-CI operates within a framework of total transparency, preserving the confidence of economic actors and protecting users' rights.
